- Your product is suitable for use in moderate and semi-tropical climates only. Set up your product in accordance with the FREmedica™ product documentation, included in this package.
- Operate your product only as instructed by FREmedica™ or your healthcare and services provider.
- Do not use your product near water, including dripping or splashing sources (e.g. indoor fountains or near objects filled with liquids, such as flower vases or fish tanks).
- Do not push objects other than the supplied charging accessory into the USB port. Doing so may damage your device, create an electric shock and/or fire hazard.
- Do not, under any circumstances, modify your product, the power cord or power supply. If the plug does not fit into your AC outlet, have a certified electrician replace your obsolete AC outlet. Protect the power cord from being stepped on or pinched, especially where the cord exits the products or plugs into an AC outlet or power strip.
- Unplug your device during lightning storms or when it’s not being used for long periods of time.
- Only use approved attachments and accessories supplied by FREmedica™.
- Refer all servicing and repair to qualified service personnel. Servicing is required when your product does not operate normally; the power cord/plug has been damaged; the product has been exposed to water, rain, liquid, or moisture; the product has been dropped; or any foreign object is inserted into the product charging port.
- Clean your product using only a dry cloth (no water or liquid). Protect your eyes. The Light-Emitting Diodes (LEDs) in your product do not emit harmful frequencies, however, staring into them for any length of time may cause short-term or permanent vision loss to occur. Do not expose your eyes to the LEDs for extended durations.
DO NOT USE
Do not use the FREmedica™ Wave 1 device and associated frequency files if you are pregnant, trying to get pregnant, suspect you might be pregnant or are lactating. Consult your medical professional before use if you have a serious medical condition including but not limited to: Cancer, Stroke, High Blood pressure, Seizure disorders etc. See “Full Disclaimer” below.
ESTABLISH A COMFORTABLE USAGE DURATION
All FREmedica™ Wave 1 devices are initially set at Level 2 frequency intensity. In the first few days, start your usage gradually. Test your body for a few minutes at a time for comfortability. If at any time you experience discomfort, contact FREmedica™ or your healthcare practitioner for advice. Do not continue to use until you have discussed the issue with FREmedica support personnel.
DISPOSAL GUIDELINES AT PRODUCT END OF LIFE
Some FREmedica™ products are non-serviceable, including rechargeable batteries, which should last the duration of the product warranty. Do not attempt to change the battery yourself. If the battery no longer holds a charge and you do not want FREmedica™ to replace the battery, consult local laws and regulations for the proper disposal of batteries and electronic devices in your region. If there are no local regulations concerning electronic waste disposal, place your product (and its battery) in a waste bin for electronic devices.
POWER SUPPLY WARNING – Caution: Electric Shock/Fire Hazard!
For interior use only. Do not expose to moisture, liquid, or heat. Do not use a damaged power supply or try to repair one that is damaged. Do not immerse the power supply in water or subject to physical abuse. Inspect the power supply regularly for damage to its cable, plug, and case.
LIMITATION OF LIABILITY
UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY, WHETHER IN TORT, CONTRACT OR OTHERWISE, SHALL WAVE FORCE ELECTRONICS INC. ™ OR FREMEDICA™, ITS SUCCESSORS OR ASSIGNS, OR ANY AUTHORIZED DEALER, BE LIABLE TO THE CUSTOMER UNDER THIS AGREEMENT FOR ANY LOSS OF PROFITS, LOSS OR CORRUPTION OF DATA, EQUIPMENT, APPLICATION OR NETWORK DOWNTIME, OR FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR EXEMPLARY DAMAGES OF ANY KIND WHATSOEVER ARISING FROM OR RELATED TO THIS AGREEMENT OR THE CUSTOMER’S USE OR INABILITY TO USE THE HARDWARE, SERVICE OR FREQUENCIES, EVEN IF SUCH PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL FREMEDICA™ AND ITS AUTHORIZED DEALERS’ TOTAL LIABILITY TO THE CUSTOMER FOR ALL DAMAGES IN ANY ONE OR MORE CAUSES OF ACTION, WHETHER IN CONTRACT, TORT OR OTHERWISE, EXCEED THE AMOUNTS PAID BY THE CUSTOMER FOR THE SERVICE DURING THE TWELVE MONTHS PRECEDING THE ACCRUAL OF SUCH ACTION.
The foregoing provisions shall be enforceable to the maximum extent permitted by applicable law and shall survive the termination or expiration any associated or related agreement.
WAIVER OF JURY TRIAL
The customer irrevocably waives, to the extent permitted by law, all rights to trial by jury in any action, proceeding or counterclaim (whether in contract, stature, tort (e.g. negligence), or otherwise relating to this any associated or related agreements.
GENERAL
The use of FREmedica’s™ WAVE 1 device and any associated or related agreements is governed by the Laws of British Columbia, Canada without reference to conflict of laws principles. The application of the United Nations Convention of Contracts for the International Sale of Goods is expressly excluded. Any dispute between the owner and FREmedica™ regarding said device(s) and/or agreements will be subject to the exclusive jurisdiction of the province and federal courts in the Province of British Columbia.
Any associated or related agreements are the entire agreements between the customer and FREmedica™ and supersedes any other communications or advertising with respect to the services and documentation, including any online agreements presented to Practitioner during registration or any additional terms or conditions submitted by Practitioner, whether part of a purchase order or otherwise. If any provision of any associated or related agreements is held invalid, the remainder of this documents language will continue in full force and effect. No provision of this document shall be deemed waived or modified except in writing signed by an authorized representative of FREmedica™.
By purchasing this product, I agree to release liability and hold blameless FREmedica™ including any and all affiliates, directors, officers, employees, agents from all causes of action, suits, penalties, liens, and judgments liabilities, obligations, losses, actual or consequential damages, actual or threatened claims which may arise at any time by reason of relating to, arising directly or indirectly out of any matter whatsoever related to dispensing FREmedica’s™ Wave 1 device.
It is further agreed that should you become aware or suspect any negative changes in physical and/or mental/emotional conditions, you will notify FREmedica™ of such changes, and agree to hold FREmedica™ harmless for any adverse effects from continuing the use of this product.
Frequency protocols and opinions on training vary among practitioners, and that there is no guarantee that this product may be beneficial. It is also agreed that should you suffer any adverse effects while using this product you will immediately contact a licensed physician or mental health clinician whose care you are under.
WHAT IS COVERED
The warranty obligations for this product are strictly limited to manufacturer defects in materials and workmanship in this product for one (1) calendar year from the date of purchase. There are no refunds, only replacement in the case of manufacturer defect(s).
FREmedica’s Warranty and Return policy is the same company-wide, including the terms for Referral and Reseller Affiliates.
ACTIVATE YOUR LIMITED WARRANTY
To obtain a remedy under this limited warranty:
- Contact FREmedica™ at returns@fremedica.com
- Only return the pre-authorized affected product, using the prepaid return documents provided by FREmedica™, to the designated shipping provider within 7 business days.
- Include in this package:
- A short-detailed description of the problem, along with the name and phone number of the contact person, and
- A copy of the original bill of sale, your credit receipt, or any other documentation on the proof of purchase. This product should be properly packed for shipping, preferably in the original carton.
HOW LONG DOES THIS COVERAGE LAST?
This limited warranty lasts for one (1) year from the date of original purchase.
WHO IS COVERED?
Only the original purchaser of this product is covered under this limited warranty This limited warranty is not transferable to subsequent purchasers or owners of this product.
LIMITATION ON LIABILITY
THE MAXIMUM LIABILITY OF FREMEDICA UNDER THIS LIMITED WARRANTY SHALL NOT EXCEED THE ACTUAL PURCHASE PRICE PAID FOR THE PRODUCT. TO THE MAXIMUM EXTENT PERMITTED BY LAW, FREMEDICA™ IS NOT RESPONSIBLE FOR DIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES RESULTING FROM ANY BREACH OF WARRANTY OR CONDITION, OR UNDER ANY OTHER LEGAL THEORY.
Some countries, districts or states do not allow the exclusion or limitation of relief, special, incidental, consequential, or indirect damages, or the limitation of liability to specified amounts, so the above limitations or exclusions may not apply to you.
EXCLUSIVE REMEDY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THIS LIMITED WARRANTY AND THE REMEDIES SET FORTH ABOVE ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, REMEDIES AND CONDITIONS, WHETHER ORAL OR WRITTEN, EXPRESS, OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, FREMEDICA SPECIFICALLY DISCLAIMS ANY AND ALL IMPLIED WARRANTIES, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. IF FREMEDICA CANNOT LAWFULLY DISCLAIM OR EXCLUDE IMPLIED WARRANTIES UNDER APPLICABLE LAW, THEN ALL IMPLIED WARRANTIES COVERING THIS PRODUCT, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, SHALL APPLY TO THIS PRODUCT AS PROVIDED UNDER APPLICABLE LAW. IF ANY PRODUCT TO WHICH THIS LIMITED WARRANTY APPLIES IS A “CONSUMER PRODUCT” UNDER THE MAGNUSON-MOSS WARRANTY ACT (15 U.S.C.A. §2301, ET SEQ.) OR OTHER APPLICABLE LAW, THE FOREGOING DISCLAIMER OF IMPLIED WARRANTIES SHALL NOT APPLY TO YOU, AND ALL IMPLIED WARRANTIES ON THIS PRODUCT, INCLUDING WARRANTIES OF
MERCHANTABILITY AND FITNESS FOR THE PARTICULAR PURPOSE, SHALL APPLY AS PROVIDED UNDER APPLICABLE LAW.
OTHER CONDITIONS
This limited warranty gives you specific legal rights, and you may have other rights which vary from country to country or state to state. This limited warranty is void if: (i) the product has been opened and or tampered with by someone other than an authorized FREmedica service provider, (ii) the product has sustained water damage, other accidental or intentional damage, or been misused or abused, (iii) the product is not distributed by FREmedica™ or, (iv) this product is not purchased from an authorized FREmedica™ reseller.
